1. Acceptance of Terms

By accessing or using PRISM ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a school or district, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

PRISM is an educational platform providing:

  • Standards-based learning management
  • Student assessment and progress tracking
  • Professional Learning Community (PLC) tools
  • Intervention and enrichment session management
  • Classroom roster management and Google Classroom integration
  • AI-powered educational content generation

3. User Accounts and Roles

Account Types

The Service supports the following user roles:

  • Platform Owner: Full system administration
  • District Administrator: District-wide management
  • School Administrator: School-level management
  • Teacher: Classroom and student management
  • Student: Access to assigned learning materials
  • Parent: View student progress (when enabled)

Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring accuracy of account information

4. Acceptable Use Policy

You MAY:

  • Use the Service for legitimate educational purposes
  • Access and manage student data as authorized by your role
  • Generate educational content using AI features
  • Integrate with approved third-party services (e.g., Google Classroom)

You MAY NOT:

  • Share login credentials with unauthorized individuals
  • Attempt to access data beyond your authorized scope
  • Use the Service for commercial or non-educational purposes
  • Upload malicious code or attempt to compromise security
  • Harass, bully, or intimidate other users
  • Violate any applicable laws or regulations
  • Scrape, mine, or harvest data from the Service
  • Bypass or circumvent any access restrictions

5. Student Data and Privacy

We take student privacy seriously and comply with:

  • Family Educational Rights and Privacy Act (FERPA)
  • Children's Online Privacy Protection Act (COPPA)
  • Applicable state student privacy laws

Schools retain ownership and control of student data. We act as a "school official" under FERPA and will only use student data to provide and improve educational services.

6. Intellectual Property

Our Content

The Service, including its design, features, and content (excluding user-generated content), is owned by PRISM and protected by intellectual property laws.

Your Content

You retain ownership of content you create using the Service. By using the Service, you grant us a license to use, store, and display your content solely to provide the Service.

Educational Standards

Educational standards data is sourced from the Common Standards Project and other public sources. Use of standards must comply with their respective licenses.

7. AI-Generated Content

When using AI features to generate educational content:

  • Review all AI-generated content for accuracy and appropriateness
  • You are responsible for any content you choose to use
  • AI-generated content should supplement, not replace, professional judgment
  • Do not input sensitive student information into AI prompts

8. Third-Party Integrations

The Service integrates with third-party services like Google Classroom. Use of these integrations is subject to the third party's terms of service. We are not responsible for third-party service availability or functionality.

9. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We will attempt to notify users of planned maintenance when possible.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRISM LEARN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify and hold harmless PRISM from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service if you:

  • Violate these Terms of Service
  • Engage in conduct harmful to other users or the Service
  • Fail to pay applicable fees (if any)

Schools and districts may terminate their use of the Service at any time. Upon request during the termination process, we will work with administrators to provide available data exports (such as student profiles and assessment data) in standard formats like CSV, subject to technical feasibility.

14. Governing Law

These Terms shall be governed by the laws of the United States and the State in which your school or district is located, without regard to conflict of law provisions.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be notified to administrators via email or platform notification. Continued use after changes constitutes acceptance of the modified Terms.

17. Entire Agreement
